Overview

HWA Merch is operated by HWA, Inc. These Terms of Service govern your use of hwamerch.com and your purchase of products from HWA Merch. Throughout these Terms, “HWA Merch,” “we,” “us,” and “our” refer to HWA Merch.

By visiting our website, creating an optional customer account, or placing an order, you agree to these Terms and to the policies referenced in them. If you do not agree, please do not use the website or place an order.

Store Eligibility and Acceptable Use

You may use this website only for lawful personal or business purposes. If you are not legally able to enter into a binding agreement where you live, a parent or legal guardian must place the order for you.

You may not misuse the website, interfere with its operation or security, attempt unauthorized access, introduce harmful code, commit fraud, violate another person’s rights, or use HWA Merch products, content, or services for an unlawful purpose.

Customer Accounts

Customer accounts are optional. If you create an account, you are responsible for providing accurate information, protecting your login credentials, and notifying us promptly if you believe your account has been used without permission.

We may restrict or close an account when reasonably necessary to address fraud, misuse, security concerns, or violations of these Terms.

Products and Product Information

We work to describe and display our products accurately. Colors and details may appear differently depending on your screen, device, lighting, and manufacturing variations. Because many products are printed and made to order, minor variations that do not constitute a defect may occur.

Product availability, designs, colors, sizes, specifications, and pricing may change. We may correct genuine errors in product information or pricing. If a material error affects an order, we will contact you and provide an appropriate option, which may include confirming the corrected order or canceling and refunding it.

Orders and Order Acceptance

Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges that we received your order but does not guarantee acceptance. We may decline or cancel an order for legitimate reasons, including suspected fraud, payment problems, product unavailability, incorrect pricing or product information, shipping limitations, or violation of these Terms.

If we cancel an order after payment has been collected, we will refund the canceled amount to the original payment method.

You are responsible for reviewing product selections, sizes, colors, personalization, quantities, billing information, and delivery information before submitting an order.

Prices, Taxes, and Payment

Prices are shown in U.S. dollars unless stated otherwise. Applicable taxes and shipping charges are displayed during checkout before you submit the order.

Payments are processed through Shopify and available payment providers. HWA Merch does not receive or store your complete payment-card number. Payment methods may change over time and may include major payment cards, Shop Pay, Apple Pay, Google Pay, and PayPal where available.

You represent that you are authorized to use the payment method supplied for an order and that the billing information you provide is accurate.

Made-to-Order Products, Changes, and Cancellations

HWA Merch products are generally made after an order is placed. If you need to change or cancel an order, contact support@hwamerch.com immediately. We will make every reasonable effort to help if production has not started, but we cannot guarantee a change or cancellation because orders may enter production quickly.

Once production begins, an order cannot be changed or canceled.

Size and Selection Responsibility

Customers are responsible for selecting the correct product, size, color, and style. Before ordering apparel, review the product-specific Size Guide located near the size selector and compare its measurements with an item that fits comfortably.

Because products are made to order, we do not accept returns or exchanges for a wrong size, wrong color, change of mind, or preference for a different fit, style, or color. If HWA Merch sends a size or color different from the order confirmation, the item is treated as an incorrect item under our Refund and Return Policy.

Shipping and Delivery

HWA Merch currently ships throughout the United States, including Alaska and Hawaii. Current shipping charges, free-shipping thresholds, delivery estimates, address responsibilities, and procedures for delayed, lost, or delivered-but-missing packages are explained in our Shipping Policy.

Delivery dates are estimates rather than guarantees. Delays may occur because of production, carrier operations, weather, emergencies, incorrect addresses, or events outside our reasonable control. We will communicate material order issues when reasonably possible.

Returns, Refunds, and Product Problems

Returns, replacements, refunds, damaged or defective items, misprints, incorrect items, lost packages, and delivered-but-missing packages are governed by our Refund and Return Policy.

Damaged, defective, misprinted, or incorrect-item claims must be reported to support@hwamerch.com within 30 days of receipt and must include the information and photographs requested in that policy. Packages believed to be lost in transit must be reported within 30 days of the estimated delivery date.

Nothing in these Terms limits rights that cannot lawfully be limited under applicable consumer-protection law.

Personalized and Customer-Supplied Content

For personalized or customized products, you are responsible for checking and approving all names, dates, photographs, colors, sizes, spelling, and other supplied or approved details before production.

You must own or have permission to use any photograph, artwork, logo, name, likeness, text, or other material you submit to HWA Merch. You authorize HWA Merch and its production providers to use that material only as reasonably necessary to prepare proofs, produce the requested products, provide customer service, and complete the order.

You may not submit unlawful, infringing, deceptive, threatening, hateful, obscene, or otherwise harmful material. We may decline or cancel a custom order that reasonably appears to violate these Terms or another person’s rights.

HWA Merch Intellectual Property

The website and its HWA Merch content—including original artwork, characters, logos, brand names, product designs, photographs, graphics, text, video, and layout—are owned by or licensed to HWA Merch and are protected by applicable intellectual-property laws.

You may view the website and use its ordinary shopping functions for personal, noncommercial purposes. You may not copy, reproduce, modify, distribute, sell, exploit, or create derivative works from HWA Merch content without prior written permission, except where applicable law expressly permits the use.

Purchasing a product does not transfer ownership of the artwork, logo, character, brand, or other intellectual property printed on or associated with that product.

Reviews, Feedback, and Communications

If you voluntarily provide a review, suggestion, or other feedback, you give HWA Merch permission to use and share it for legitimate business purposes without payment, provided we do not use your name, photograph, likeness, or endorsement in a materially different way without any permission required by law.

You remain responsible for the accuracy and lawfulness of content you submit. Reviews and communications must not be fraudulent, abusive, infringing, or misleading.

Third-Party Services and Links

Our store relies on third parties such as Shopify, payment providers, production and fulfillment partners, and shipping carriers. Their services may be governed by their own terms and privacy notices.

Our website may link to third-party websites. HWA Merch does not control and is not responsible for their content, availability, privacy, security, or business practices. A link does not necessarily mean that HWA Merch endorses the third party.

Website Availability and Disclaimer

We work to keep the website and store information available and accurate, but we do not promise uninterrupted or error-free access. The website may occasionally be unavailable for maintenance, security, technical problems, or circumstances outside our reasonable control.

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis. These Terms do not exclude product warranties, consumer rights, or other protections that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by law, HWA Merch will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or purchase of products.

Where liability cannot be excluded, our liability will be limited only to the extent permitted by applicable law. Nothing in these Terms limits liability for fraud, willful misconduct, personal injury caused by negligence, or any other liability that cannot lawfully be limited.

Responsibility for Misuse or Rights Violations

To the extent permitted by law, you are responsible for losses, claims, or reasonable costs caused by your unlawful misuse of the website, your material violation of these Terms, or customer-supplied content that infringes another person’s rights. This section does not apply to losses caused by HWA Merch or to responsibilities that applicable law does not permit us to place on a customer.

Changes to These Terms

We may update these Terms to reflect changes in our store, services, policies, or legal obligations. The revised Terms will be posted on the website with an updated effective date. Changes apply prospectively unless applicable law requires otherwise.

Severability and No Waiver

If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law. If HWA Merch does not enforce a provision on one occasion, that does not waive the right to enforce it later.

Governing Law

These Terms and any dispute arising from them are governed by the laws of the State of Georgia and applicable federal law, without regard to conflict-of-law principles. This choice of law does not deprive a customer of any non-waivable consumer protection provided by the law that applies where the customer lives.
